NO HARASSMENT

Roadway is committed to maintaining a work environment free of harassment based on race, color, sex (including same-sex), religion, age, national origin, disability or other classification protected by applicable federal, state or local law. Any such harassment of any of our employees, applicants or customers is prohibited by this policy, whether or not it also violates applicable law. Harassment prohibited by this policy includes, but is not limited to, the following conduct:

Our supervisors and managers are covered by this policy and are prohibited from engaging in any form of harassing conduct. No supervisor or other member of management has the authority to suggest to any employee or applicant that their employment or advancement will be affected in any way by the individual's entering into (or refusing to enter into) any form of personal relationship with him or her. Harassment of our employees in connection with their work by non-employees, including vendors or customers, is also a violation of this policy.

Roadway's policy is to investigate thoroughly and to take appropriate action to remedy incidents of harassment. In order to accomplish this, however, harassment must be brought to management's attention. Accordingly, employees who have complaints of harassment or who observe or are aware of incidents of harassment must bring any such conduct to management's attention.

The following procedure should be used for reporting complaints about conduct in violation of this policy. All complaints are to be reported in writing to the:

Violation of this policy will subject an employee to disciplinary action, up to and including immediate discharge. If you have any questions about what constitutes harassing behavior or what conduct is prohibited by this policy, please submit your question in writing to the Office of the Assistant General Counsel, Internal Review Processing, 1077 Gorge Blvd., P.O. NO RETALIATION

No employee will be subject to retaliation or reprisal for reporting or threatening to report a complaint or concern under Roadway's EEO or Anti-Harassment Policies, or for participating in an investigation into allegations of violations of these policies. Any complaints of suspected retaliation or reprisal should be reported immediately to Office of the Assistant General Counsel, Internal Review Processing, 1077 Gorge Blvd., P.O. Box 471, Akron, Ohio 44309-0471 or you may contact the Hotline at 1-866-384-4277 or via the internet at www.ethicspoint.com.

This anti-retaliation provision protects any employee who makes a complaint of harassment in good faith; whether or not the company determines that the reported conduct violates this policy. However, an employee may not make frivolous or malicious complaints of harassment. Anyone who knowingly and deliberately makes a false accusation of harassment, or who knowingly provides false information to or intentionally misleads persons who are investigating a complaint of harassment, is subject to disciplinary action, up to and including discharge, for dishonesty and violation of this policy. Such disciplinary action shall not be considered retaliation or reprisal under this policy.
