Shipments Originating in Canada
Shipments originating in Canada are subject to the Canadian bill of lading contract terms and conditions. Included below are some of the more significant conditions:
- Notice of loss, damage, or delay of goods must state the origin, destination, date of shipment, and estimated amount of the claim.
- Notice of claim must be received in writing by the origin carrier or delivering carrier within 60 days after delivery or, in the case of a complete nondelivery, within nine months from the date of shipment.
- The final statement of claim with the specified amount of the claim must be received by the carrier within nine months from the date of shipment.
- Carriers liability is determined by the manner in which the shipper prepares the bill of lading. Carrier liability is limited to Can$2 per pound times the weight of the entire shipment. Excess liability coverage is available if the shipper declares a value on the bill of lading in the appropriate location and pays the excess liability charge as stated in Item 780 of RDWY 100 series.
